Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of this website, and any products or services offered through it (together, the “Services”). By using the Services or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Our Store is powered by Shopify, which provides the ecommerce platform we use to sell our products. Your purchase contract is with us, not with Shopify.

2) Eligibility & Accounts

You must be at least 18 years old, or have a parent/guardian’s consent, to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3) Products (Pre-owned / New) & Availability

Pre-owned items: We sell pre-owned eyewear and accessories. Each item is unique and may show signs of normal wear. Product pages describe the item’s condition and any visible wear where known.

New items (if offered): If we offer items marked as “New”, their condition will be stated on the product page.

We aim to display product information accurately, but colours and details may vary by device and lighting. We may change, discontinue, or limit quantities of any product at any time.

4) Orders & Contract Formation

Placing an order is an offer to purchase. We may accept or reject orders for legitimate reasons (e.g., availability, pricing errors, suspected fraud). A binding contract is formed when payment is processed and you receive an order confirmation. Purchases are for personal use and not for resale.

5) Prices, Taxes & Billing

Prices are shown in EUR and include VAT where applicable unless stated otherwise. Shipping fees and any additional charges are shown at checkout.

If your order is shipped internationally, customs duties, import VAT, handling fees, or other charges may apply depending on destination rules, unless explicitly stated otherwise at checkout.

You agree to provide current and accurate billing and contact details, and you authorize us (and our payment providers) to charge your selected payment method for the total amount due.

6) Shipping & Delivery

We work with carefully selected EU-based logistics and fulfillment partners to ensure reliable and efficient delivery.

Some items may be dispatched from our logistics partners’ facilities within the EU.

We remain responsible for your order and delivery until it reaches you.

Shipping costs and estimated delivery times are displayed at checkout. Delivery times are estimates and may be affected by carriers, customs, or events beyond our control. Orders may arrive in multiple packages.

Nothing in these Terms limits your mandatory consumer rights. For consumer orders, we remain responsible for delivery until the goods are delivered to you (or to a party you nominate to receive them).

7) Returns & EU/EEA Right of Withdrawal

This section explains the statutory right of withdrawal for EU/EEA consumers (where applicable) and how returns are handled. For additional practical details, please see our Return & Refund Policy.

7.1 EU/EEA statutory right of withdrawal (distance purchases)

If you are an EU/EEA consumer, you generally have a statutory right to withdraw from a distance purchase within 14 days from delivery without giving any reason, subject to legal exceptions.

This statutory right of withdrawal applies also to pre-owned items unless a specific legal exception applies.

  • How to withdraw: Email us at info@siluante.com within 14 days of delivery with your order number and a clear statement that you wish to withdraw.
  • Return deadline: After you notify us, you must send the goods back without undue delay and no later than 14 days after your withdrawal notice.
  • Contact us first: Before returning any item, you must contact us. We will provide (if applicable) return authorization, step-by-step instructions, and the correct return address. The return address may differ from the shipping address. Please do not send returns without contacting us first.
  • Return costs: Unless we state otherwise, you are responsible for the direct cost of returning the goods.
  • Handling & diminished value: You may handle the goods only as necessary to check their nature, characteristics, and functioning (as in a physical store). If you handle/use the goods more than necessary, we may reduce the refund to reflect diminished value.
  • Refund timing: If you withdraw, we reimburse payments received without undue delay and no later than 14 days from the day we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back or you provide evidence of having sent them back.

7.2 No voluntary extended returns

Unless explicitly stated otherwise, we do not offer a voluntary “open purchase” return window beyond what is required by applicable law.

8) Damaged, Defective, or Incorrect Items

If you receive an item that is damaged in transit, incorrect, or materially not as described, please contact us at info@siluante.com as soon as possible and include your order number and clear photos (video if helpful).

If the issue is confirmed, we will arrange an appropriate solution (refund, replacement when available, or return instructions). Claims are not accepted when the issue results from customer misuse, normal wear and tear consistent with the stated condition, or damage after delivery.

9) Intellectual Property

All content on the Services (including trademarks, text, images, graphics, video, audio, and layout) is owned by us or our licensors and is protected by law. You may use the Services for personal, non-commercial purposes only. Any other use requires our prior written consent.

10) Third-Party Tools & Links

We may provide access to third-party tools or links. Such tools and sites are provided “as is.” Your use is at your own risk and subject to the third party’s terms and policies.

11) Privacy & Cookies

Your use of the Services is subject to our Privacy Policy and any cookie policy/consent settings shown on the website.

12) Prohibited Use

You agree not to misuse the Services (including unlawful activity, infringing intellectual property rights, transmitting malware, spamming, scraping, or interfering with the security or operation of the Services). We may suspend or terminate access for violations.

13) Warranties & Limitation of Liability

We provide the Services with reasonable care, but we do not guarantee they will be uninterrupted or error-free. Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights under mandatory law.

To the extent permitted by law, our total liability for any claim relating to a specific purchase will not exceed the price paid for the product concerned.

This does not limit your statutory consumer rights under mandatory law.

14) Governing Law & Disputes

These Terms are governed by the laws of Finland, and mandatory EU/EEA consumer protection rules apply where relevant. If you are a consumer, you may bring claims in your local courts as permitted by applicable law.

15) Changes

We may update these Terms from time to time. The updated Terms will be posted here with a new “Last updated” date. Continued use of the Services after changes constitutes acceptance.
